Falling Bird Terms & Conditions
Introduction
I would first like to thank each and every client and/or customer who has taken the time to read through this to inform themselves with the finer but important details of continuing your experience and/or service with Falling Bird. It is and will always be important to stay updated and informed.
These term & conditions will go over the services I offer on this website (commissions, print club and any other), products for sale through this website’s shop (any listed product on the site store, print-club, ACEO’S prints, art), and original art sold on the website.
User obligations & responsibilities
Although I love catering for the kids, this is a website designed and built by an adult artist, so although an R rating is unnecessary, a swear word or two can be expected. It is advised that any individual under 16 be monitored by a guardian or parent.
When you decide to support, it is also important to remember and take care to enter the correct information when ordering or creating an account. If an error occurs due to wrong information given, there will be a limited solution that could be offered.
When in communication with Falling Bird, no matter who it may be, rudeness, bullying, abuse, and/or harassment from any client, at any moment, will not be tolerated. In the case that any of these should happen, any transaction or sale can be ended. If the transaction is ended after Falling Bird has received payment, Falling Bird shall issue a full refund. Comments and any other formal and informal form of communication will also be subject to these standards.
For the most important part, any and all content is subject to copyright. Sharing any content or mass-producing purchased content will be subject to legal action.
Falling Bird obligations and responsibilities
Falling Bird is responsible for updating pricing and keeping prices up-to-date before a client or customer buys an item. Falling Bird is also responsible for all discussed pricing for commissions. In the case of damaged goods due to neglect on Falling Bird’s behalf (if Falling Bird is found to be at fault), Falling Bird will be responsible for replacing art or products or for a refund (full or part).
Falling Bird is responsible for packaging and safely shipping all products that are not shipped through other parties (Printful). In the case of a refund or replacement, Falling Bird is responsible for the shipment of the new and damaged product.
Commissions
All commissions requested are subject to rejection by the artist based on price, availability, subject, and discretion. Any commissions can only be moved forward or started with after both artist and patron have agreed and signed the agreement document (provided by the artist upon commission request), and after a deposit (that is agreed on) for the commission has been paid. Commissions are also subject to a limited number of changes during the process and in the final stages (also agreed beforehand).
Once the patron has approved and accepted the final work, the work will be sent/shipped to the patron. It is the responsibility of Falling Bird to properly package the commissioned work. Falling Bird is also responsible for any damage caused due to neglect on Falling Bird’s behalf in the packaging and shipping process. In the case of damage due to neglect on Falling Bird’s account refund (full or partly) or replacement of the commission will be issued (after thorough investigation).
Products
All purchases are final upon payment, and all transactions are concluded after the order has been accepted by the client/customer. All products fall under the previously mentioned copyright, and legal action can and will be taken if the products are copied, sold, or mass-produced. All complaints and suggestions about any products will be appreciated and considered by Falling Bird. In the case of damage due to printing error or neglect on Falling Bird’s account refund (full or partly) or replacement of the product will be issued (after thorough investigation).
ZA Only Products
All ZA Only products are only available in South Africa and are subject to lower prices than internationally available products. ZA products are subject to availability.
International Products
Internationally available products are subject to more price fluctuations than ZA Only products and are subject to the international shipping prices and delays. International products are also reliant on the shipping terms and conditions of the manufacturer used by Falling Bird (Printful).
